Terms of Service

1. Acceptance of Terms

By accessing or using the services of Blessings Telehealth Services LLC ("Blessings," "we," "us," or "our"), including our website, client portal, payment platform, and in-home or virtual services, you ("Client," "you," or "your") agree to be bound by these Terms of Service.

If you do not agree to these Terms, please do not use our services.

2. Description of Services

Blessings provides:

• Personal Care Services: In-home daily living assistance, companionship, medication management support, light housekeeping, virtual wellness visits, and care coordination.
• Coaching Services: Marriage and relationship coaching, premarital coaching, individual coaching, faith-integrated coaching sessions, and ADHD & behavioral coaching for individuals, couples, and families.
• Care Coordination: Communication with family members, healthcare providers, and other agencies on your behalf with your authorization.

3. Eligibility

You must be at least 18 years of age to enter into this agreement, or have a parent or legal guardian agree on your behalf. Services for minors require parental or guardian consent and are subject to all applicable state laws.

In-home services are provided within our defined service area in the Capital Region of New York. Virtual coaching is available to clients located in New York and Pennsylvania.

4. Your Account

To use our client portal, you must create an account with accurate information. You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately of any unauthorized access

5. Payments, Fees & Refunds

Payment

Payments are processed through Stripe, a PCI-compliant payment processor. We accept major credit cards, ACH, Medicaid, and select long-term care insurance plans. You agree to provide accurate billing information and authorize charges for services you request.

Pricing

Current rates are published on our website and may be updated from time to time. You will be informed of any price change before any new charge is incurred.

Refund Policy

• Coaching sessions: Cancellations more than 24 hours in advance are fully refundable. Cancellations within 24 hours are charged 50% of the session fee.
• Personal care: Cancellations more than 24 hours in advance are not charged. Same-day cancellations are charged a 2-hour minimum.
• Disputes: Contact us within 30 days of the charge to dispute. We make good-faith efforts to resolve all disputes promptly.

6. Telehealth-Specific Terms

By using our virtual coaching and wellness video visits, you acknowledge and agree that:

• Telehealth involves the use of electronic communications to deliver services remotely.
• Internet outages, technical issues, or device failures may interrupt or end a session.
• Although we take privacy seriously and use HIPAA-compliant platforms, no electronic communication system is 100% secure.
• If you find telehealth is not meeting your needs, you have the right to discontinue at any time and seek in-person care.
• You are responsible for being in a private, safe location during sessions.

7. Scope of Practice & Disclaimers

Blessings provides coaching, personal care, and wellness services. We are not a substitute for licensed medical, psychiatric, or psychological treatment.

Our coaching services are not psychotherapy and are not intended to diagnose, treat, cure, or prevent any mental health disorder. If you are experiencing symptoms of a mental health condition, we will encourage you to seek appropriate licensed care and may decline to continue coaching if a higher level of care is needed.

Our personal care staff follow client care plans developed in coordination with primary healthcare providers. We do not prescribe medication, perform medical procedures, or provide skilled nursing services beyond the scope of our licensure.

9. Prohibited Uses

You agree NOT to:

• Use our services for any unlawful purpose
• Misrepresent your identity or eligibility
• Harass, abuse, or harm any staff member or caregiver
• Record sessions without explicit consent from all parties
• Share your portal login with unauthorized persons
• Attempt to gain unauthorized access to our systems
• Use our intellectual property without permission

10. Intellectual Property

All content on our website, portal, and printed materials — including text, logos, images, audio, video, and design — is the property of Blessings Telehealth Services LLC or its licensors and is protected by copyright and trademark laws. You may not reproduce, distribute, modify, or create derivative works without our written permission.

11. Limitation of Liability

To the fullest extent permitted by law, Blessings Telehealth Services LLC and its officers, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our services.

Our total liability for any claim arising from our services shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold Blessings Telehealth Services LLC harmless from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your use of our services, or your violation of any rights of a third party.

13. Governing Law

These Terms are governed by the laws of the State of New York, without regard to its conflict of laws principles. Any disputes shall be resolved in the state or federal courts located in Rensselaer County, New York, and you consent to the jurisdiction of those courts.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated to you by email or through the client portal. Continued use of our services after changes constitutes acceptance of the updated Terms.
